1. Agreement to Terms

By accessing or using MOOSE FAN APP ("the App"), a product of Moose Clothing Company ("Moose Clothing," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms apply to all users of the App, including without limitation users who are browsers, customers, merchants, and contributors of content. MOOSE FAN APP is exclusively designed for cricket fans to engage with match predictions, purchase merchandise, and participate in community activities.

2. Eligibility and Account Registration

To use MOOSE FAN APP, you must:

• Be at least 13 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding agreements
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3. Use of the App

3.1 Permitted Use

You may use MOOSE FAN APP for lawful purposes only, including:

• Making cricket match predictions
• Browsing and purchasing merchandise
• Viewing studio videos and content
• Participating in community features
• Receiving notifications and updates

3.2 Prohibited Activities

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's operation or security
• Use automated systems to access the App without authorization
• Impersonate any person or entity
• Collect or harvest information about other users
• Engage in any fraudulent, deceptive, or manipulative activities

4. Cricket Predictions

MOOSE FAN APP allows users to make predictions on cricket matches. By participating in predictions, you agree to the following:

• One Prediction Per Match: Each user may submit only one prediction per match. Predictions cannot be changed once submitted.
• Prediction Windows: Predictions can only be made during designated time windows for each match.
• Prize Eligibility: Prizes are awarded based on prediction accuracy and are subject to verification. We reserve the right to disqualify any user who violates these Terms.
• No Guarantee: We do not guarantee any specific outcomes or winnings from predictions.
• Fair Play: Any attempt to manipulate predictions, use multiple accounts, or engage in fraudulent behavior will result in immediate account termination.

5. Shopping and Merchandise

5.1 Product Information

We strive to provide accurate product descriptions, images, and pricing. However, we do not warrant that product descriptions or other content is accurate, complete, reliable, current, or error-free. Prices and availability are subject to change without notice.

5.2 Orders and Payment

• All orders are subject to product availability and acceptance
• We reserve the right to refuse or cancel any order for any reason
• Payment must be completed through approved payment methods (Card or Cash on Delivery)
• Orders are processed only after payment confirmation
• Prices are in Sri Lankan Rupees (LKR) unless otherwise stated

5.3 Shipping and Delivery

Shipping terms, delivery times, and costs will be communicated at checkout. We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

6. Vouchers and Promotions

MOOSE FAN APP may offer vouchers, discounts, and promotional offers. These offers are subject to the following terms:

• Vouchers are valid only for the specified duration and conditions
• Each voucher can only be used once per user
• Vouchers cannot be combined unless explicitly stated
• We reserve the right to modify or cancel promotions at any time
• Vouchers are non-transferable and have no cash value
• We may limit voucher eligibility based on registration order or other criteria

7. Intellectual Property

All content, features, and functionality of MOOSE FAN APP, including but not limited to text, graphics, logos, images, software, and designs, are owned by Moose Clothing Company or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from the App without our prior written permission.

8. User Content

You retain ownership of any content you submit, post, or display on the App (including photos and selfies). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for the purpose of operating and promoting the App.

You represent and warrant that you have all necessary rights to grant this license and that your content does not violate any third-party rights or applicable laws.

9. Disclaimers and Limitations of Liability

To the maximum extent permitted by law:

• We do not guarantee that the App will be uninterrupted, secure, or error-free
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not responsible for third-party services, websites, or content

10. Indemnification

You agree to indemnify, defend, and hold harmless Moose Clothing Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or conduct

11. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause or notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the App or other users
• Request by law enforcement or government authorities

Upon termination, your right to use the App will immediately cease. We may delete your account and all associated data, subject to our legal obligations.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiation, and if necessary, through the courts of Sri Lanka.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
